This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User" or "you") and Streaming Artist Agency ("Company," "we," "us," or "our"), governing your use of the BehaviorCam application, including all related services, features, content, and updates (collectively, the "Application"). By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.
1. License Grant
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on devices you own or control, solely for your personal, non-commercial purposes.
This license does not allow you to:
- Copy, modify, distribute, sell, lease, sublicense, or otherwise transfer the Application or any portion thereof
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Application
- Use the Application for any unlawful, harmful, or unauthorized purpose
- Use the Application in any manner that could damage, disable, overburden, or impair our servers or networks
2. Eligibility
You must be at least 17 years of age to use the Application. By using the Application, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement. The Application is not intended for use by children under 17.
3. Account Registration
Certain features of the Application require you to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate this Agreement or are used fraudulently.
4. Description of the Application
BehaviorCam is an AI-powered behavioral analysis application that processes user-submitted media (photos, videos, and audio) to generate analytical insights about observable behavioral cues, including but not limited to facial expressions, body language, vocal patterns, and stress indicators.
5. Subscriptions, Tokens, and Payments
a. Free Tier
New users receive a one-time allocation of 10 free analysis tokens upon account creation. Free tokens do not renew monthly.
b. Subscription Plans
The Application offers monthly subscription plans with varying token allocations. Subscription details, pricing, and token amounts are displayed within the Application and are subject to change. Subscriptions renew automatically at the end of each 30-day billing cycle unless cancelled.
c. Token Packs
Additional tokens may be purchased as one-time token packs. Tokens are consumed based on the type and duration of analysis performed.
d. Platform-Specific Billing
- iOS and Android: In-app purchases and subscriptions are processed through Apple App Store or Google Play Store. Billing, refunds, and cancellation for mobile purchases are governed by the respective platform's terms and policies.
- Web: Purchases made through the web application are processed by Stripe. Web-based billing is governed by Stripe's terms of service and our own refund policies.
e. Token Expiration
Subscription tokens reset at the start of each billing cycle and do not carry over. Purchased token packs do not expire as long as your account remains active.
f. Refunds
Refund eligibility depends on the purchase platform. For mobile purchases, contact Apple or Google for refund requests. For web purchases, contact us within 7 days of purchase at jaime@streamingartistagency.com.
6. User Content and Media
You retain ownership of all media (photos, videos, and audio) you upload to the Application ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, analyze, and temporarily store it solely for the purpose of providing the Service.
- You represent that you have all necessary rights and permissions to upload and analyze the User Content
- You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, or that violates the rights of any third party
- You agree not to upload content depicting minors or any content that exploits, harms, or endangers children
- Media files are processed in real-time and are not permanently stored on our servers after analysis is complete
- Analysis results are stored in your account history until you choose to delete them
7. Acceptable Use
You agree not to use the Application to:
- Harass, stalk, threaten, defame, or intimidate any person
- Violate any local, state, national, or international law or regulation
- Infringe upon the intellectual property rights of others
- Upload or transmit viruses, malware, or other harmful code
- Interfere with or disrupt the integrity or performance of the Application
- Attempt to gain unauthorized access to any part of the Application or its systems
- Use analysis results as the sole basis for decisions with significant legal, employment, financial, or personal consequences
- Redistribute, publish, or commercially exploit analysis outputs without the consent of the individuals depicted in the analyzed media
- Use the Application in connection with surveillance, profiling, or monitoring of individuals without their knowledge and consent
8. Intellectual Property
The Application, including all software, algorithms, models, designs, text, graphics, logos, and other content, is the property of Streaming Artist Agency or its licensors and is protected by copyright, trademark, and other intellectual property laws.
This Agreement does not grant you any rights to our trademarks, service marks, or trade names. All rights not expressly granted in this Agreement are reserved by the Company.
9. Third-Party Services
The Application may integrate with or rely upon third-party services, including but not limited to:
- AI and machine learning providers (Google Gemini, OpenAI) for media analysis
- Payment processors (Apple, Google, Stripe) for billing
- Authentication providers (Apple, Google) for sign-in
Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services.
10. Privacy
Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Application, you consent to the practices described in the Privacy Policy.
11. Disclaimer of Warranties
We do not warrant that:
- The Application will be uninterrupted, error-free, or secure
- Analysis results will be accurate, complete, or reliable
- Any defects or errors will be corrected
- The Application will meet your specific requirements or expectations
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STREAMING ARTIST AGENCY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Streaming Artist Agency and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:
- Your use of the Application
- Your violation of this Agreement
- Your violation of any rights of a third party
- Any User Content you upload or submit through the Application
14. Termination
This Agreement is effective until terminated. We may terminate or suspend your access to the Application at any time, with or without cause, and with or without notice. Upon termination:
- Your license to use the Application is immediately revoked
- You must cease all use of the Application and delete all copies
- Your account data may be deleted in accordance with our Privacy Policy
- Sections regarding intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive termination
You may terminate this Agreement at any time by deleting your account and uninstalling the Application from all devices.
15. Dispute Resolution
a. Informal Resolution
Before initiating formal proceedings, you agree to contact us at jaime@streamingartistagency.com and attempt to resolve any dispute informally for at least 30 days.
b. Binding Arbitration
If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Wyoming, United States, or at another mutually agreed location.
c. Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive the right to participate in any class action, class arbitration, or representative proceeding.
16. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Wyoming.
17. Changes to This Agreement
We reserve the right to modify this Agreement at any time. When we make material changes, we will update the "Effective Date" at the top of this page and may notify you through the Application or by email. Your continued use of the Application after any changes constitutes your acceptance of the revised Agreement.
18. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19. Entire Agreement
This Agreement, together with the Privacy Policy and Child Safety Standards, constitutes the entire agreement between you and Streaming Artist Agency regarding the use of the Application and supersedes all prior agreements, understandings, and communications.
